AGBAKOBA SAYS INEC RIGHT TO SUSPEND MELAYE'S RECALL

Former President of the Nigerian Bar Association (NBA), Olisa Agbakoba has supported the action of the Independent National Electoral Commission (INEC) for suspending the recall process of Senator Dino Melaye.
Agbakoba, whose position was also supported by another Senior Advocate of Nigeria (SAN), Ola Olanipekun, said the election body had no option than to obey the law.
He said: "The law is if an appeal is filed, then it acts as a stay of proceeding in the lower court. In particular case, in addition to filing an appeal by Melaye, he would have also filed a stay of proceeding.
"Also, if the record of proceedings in the High Court has been transmitted to the Court of Appeal, then the Federal High Court will have no jurisdiction to proceed. So, it is not even for INEC to proceed, it has no right to proceed."
Also supporting INEC's decision, Olanipekun said: "Since an appeal process has been activated, it's a judicial intervention. If INEC should go ahead while the appeal process is ongoing, its decision would be ridiculed. The source of this problem is the unnecessary judicial intervention in the discharge of INEC's statutory function.
"Once the statutes give an individual or an organisation a duty to take certain steps, the courts are not supposed to restrain such person or entity from taking such steps until they have performed the functions and the process infringes on somebody's rights.
"It was wrong for the High Court to stop the INEC. The recall process is time bound. It is clearly stated in the constitution, when it must be completed; that is within 90 days. The injunction to stop INEC would never have been given in the first place. The court wouldn't have granted the injunction."

Heavily armed policemen on Tuesday in Dutse, Jigawa State capital, fired teargas canisters at a crowd that gathered at the Chief Magistrate Court Two for the arraignment of former governor Sule Lamido, who is being tried for making inciting remarks. A middle aged man has been arrested in Ilorin, the Kwara State capital for being in possession of human parts. Tribune Online gathered that the suspect had been under surveillance of residents of Ita Kudimo, Abata Suban, Pakata area of Ilorin West local government in the past few days after speculation grew that he possessed a corpse in his building. It was also gathered that the neighbours of the suspect swooped on his residence at about noon on Sunday and the suspect was allegedly caught with human parts. ROUND LAKE BEACH.– Three teens have been charged after a suburban Illinois father was killed while trying to sell his iPhone using the popular app OfferUp, according to WGN-TV. Police say 43-year-old Trinidad Bueno-Sanchez of North Chicago, a married man with a 6-year-old child, did everything right when trying to sell his cellphone. Using OfferUp, he found a potential buyer who expressed interest in purchasing his iPhone 6 for $450, and agreed to meet them in the parking lot of a Meijer store in Round Lake Beach the evening of April 24. Gunmen suspected to be militants on Thursday morning invaded Lagos State Model College, Igbo Nla, Epe, Lagos, abducting the principals and some students. The kidnappers were said to have stormed the school in the early hours when the students were at the morning assembly. The gunmen abducted the principal of the junior secondary school, Mr. Oyesola and Mr. Akirinmade who is the Principal of the senior secondary school. They also abducted some of the students.
