AGBAKOBA SAYS INEC RIGHT TO SUSPEND MELAYE'S RECALL

Former President of the Nigerian Bar Association (NBA), Olisa Agbakoba has supported the action of the Independent National Electoral Commission (INEC) for suspending the recall process of Senator Dino Melaye.
Agbakoba, whose position was also supported by another Senior Advocate of Nigeria (SAN), Ola Olanipekun, said the election body had no option than to obey the law.
He said: "The law is if an appeal is filed, then it acts as a stay of proceeding in the lower court. In particular case, in addition to filing an appeal by Melaye, he would have also filed a stay of proceeding.
"Also, if the record of proceedings in the High Court has been transmitted to the Court of Appeal, then the Federal High Court will have no jurisdiction to proceed. So, it is not even for INEC to proceed, it has no right to proceed."
Also supporting INEC's decision, Olanipekun said: "Since an appeal process has been activated, it's a judicial intervention. If INEC should go ahead while the appeal process is ongoing, its decision would be ridiculed. The source of this problem is the unnecessary judicial intervention in the discharge of INEC's statutory function.
"Once the statutes give an individual or an organisation a duty to take certain steps, the courts are not supposed to restrain such person or entity from taking such steps until they have performed the functions and the process infringes on somebody's rights.
"It was wrong for the High Court to stop the INEC. The recall process is time bound. It is clearly stated in the constitution, when it must be completed; that is within 90 days. The injunction to stop INEC would never have been given in the first place. The court wouldn't have granted the injunction."

WOMAN HIDES PHONE INSIDE SOUP FOR ROBBER LOVER TO BEAT PRISON SECURITY

An attempt by a mother of two children to smuggle a phone to her boyfriend in prison custody has been foiled by the officials of the Nigerian Prisons Service (NPS) in Abeokuta, Ogun State. The 33-year-old woman, Fatima Balogun who has been arrested by men of the Special Intelligence Unit of the NPS, carried out the action on Wednesday at the gate lodge of Abeokuta maximum Prisons in Ibara. The suspect confessed that she hid the phone which she bought for her boyfriend identified as Ganiyu Ajibode, in the cooler of soup from the Prisons officials. Balogun said she was a divorcee with two children before she met Ganiyu about two years back. In an alleged ecstasy to impress their paymaster, a team of police operatives, on Sunday, shot dead one Elvis Ovie and injured another, Onome Eko, during a party in Warri, Delta State. A Minna Chief Magistrates’ Court has granted bail to a housewife, Eucharia Mba, who was earlier apprehended by the police for allegedly selling her four-month-old baby for N605,000. Mba was arrested alongside Bright Ahuruezeanya of Chanchaga area of Minna and one Peter Ani. The defendants are facing three counts bordering on criminal conspiracy, buying and selling of a minor. The offence contravened sections 79 and 278 of the Penal Code Law. According to the police First Information Report, one Mr. John of Mechanic Junction in Chanchaga, had sometime in September, 2017 reported to the police that Amaka Bright of the same address with Bright Ahuruezeanya conspired with his wife Eucharia and sold his four-month-old baby boy. It was alleged that Eucharia and the other two accused persons left for Enugu State where they sold the baby to one Mr. Ani for N605,000.
