Alleged corruption: You lack power to demand Magu’s probe – Court tells whistleblower

An FCT High Court sitting in Jabi has told a whistleblower and lawyer, George Uboh, and his organization, George Uboh Whistleblower Network, that they lack the legal capacity to decide for the Attorney General of the Federation (AGF), Abubakar Malami, who to prosecute.

 The plaintiffs with suit number M/4853/17 had sought an order to compel the AGF to investigate Acting-chairman of Economic and Financial Crime Commission (EFCC), Ibrahim Magu and his predecessors in office for alleged corruption.

 Justice Abba-Bello Muhammad, struck out the application after listening to the submission of the applicants’ counsel, Mr Frank Tietie.

 According to the judge, the applicants have no power under the provisions of the
law to decide for the AGF who to prosecute.

 “I have examined the application of the applicants seeking an order of the court to commence an action of mandamus on the respondents.“Applicant must have a locus standi before such an application can be granted,’’ the judge said.

 According to Muhammad, a private legal practitioner has no locus standi to compel the AGF to prosecute a person.

 The judge added that Section 383 of the Administration of Criminal Justice Act (ACJA) was specific on when a private legal practitioner could compel the AGF to investigate an individual.

 The applicants had prayed the court, to exercise its powers under Section 174 of the 1999 Constitution and order the AGF to investigate and prosecute former and present EFCC chairmen.

 Those listed for investigation were Mallam Nuhu Ribadu, Mrs Farida Waziri, Mr Ibrahim Lamorde, Ibrahim Magu and Access Bank Plc.

 They averred that the EFCC chairmen were fraudulent, and refused to account for recovered money in accordance with Section 15, 16, and 17 of the EFCC Act.

 The plaintiffs said that the respondent owed them a duty to prosecute the EFCC chairman. They said that available evidence showed that Ribadu, Waziri, Lamorde, Magu and Access Bank had committed; “serious acts of fraud and corruption.”

Officials of the National Drug Law Enforcement Agency (NDLEA) at the Murtala Muhammed International Airport (MMIA) Lagos have intercepted a 54- year- old single mother of four children. She was going on pilgrimage to Saudi Arabia with substances that tested positive for cocaine. The suspect who hails from Kwara State was apprehended during the outward screening of passengers on a Qatar Airline flight to Saudi Arabia after testing positive to drug ingestion. Preliminary investigation revealed that she ingested 32 wraps of substances that tested positive for cocaine weighing 330 grammes. The suspect who hawks tea and bread to earn a living in Lagos was found to have collected N300,000 to smuggle drugs to Saudi under the pretext of going for pilgrimage. PHOTO OF THE DECEASED BEEN TAKEN AWAY An Assistant Superintendent of Customs has allegedly committed suicide in Lungu Village, Gwarinpa, Abuja. The cause of the suicide was yet to be ascertained. Sources said the man, identified as Christian, 44, locked himself in a room and hung himself with a rope on Saturday. A source said the deceased, who was unmarried, was staying with his brother and was said to have been recently transferred to Lagos before the incident happened. The Gwarinpa Divisional Police Officer, CSP Nuruddeen Sabo, said the brother whom the deceased stayed with was at a barber’s shop when the incident happened. POSTMORTEMS TO BE CARRIED OUT ON BODIES OF CANADIAN-AMERICAN COUPLE

By BBN Staff: Yesterday, the bodies of the missing Canadian-American couple were discovered near a cane field in Chan Chen village in the Corozal district. Reports to BBN is that an on site post-mortem examination is being conducted on the bodies at this time. According to these reports, the bodies are in an advanced state of decomposition. Canadian national, Francesca Matus, 52, and her boyfriend, American national, Drew Devoursney, 36, were last seen on Tuesday night leaving a bar in Corozal town. Matus was to fly to Canada, Wednesday morning. A friend who was to take Matus to the airport, American national Joseph Milholen, reported to police that he called her several times but to no avail. Milholen also called Devoursney but received no response. Police and volunteers had organized search parties from Wednesday through to Monday.
